1. Agreement to these terms

By creating a Captawave account or using the Captawave platform, you agree to these Terms of Service ("Terms"). If you are using Captawave on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. What Captawave is

Captawave is an AI-powered product intelligence platform. It captures behavioral signals from your software product via a JavaScript SDK, analyzes them, and generates insights, recommendations, review drafts, churn alerts, and other outputs to help you improve your product and grow your business.

3. Your account

  • You must provide accurate information when creating your account and keep it up to date.
  • You are responsible for keeping your API keys and login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years old to use Captawave.
  • One account per person or organization. You may not share accounts.

4. Acceptable use

You may use Captawave only for lawful purposes. You agree not to:

  • Install the Captawave SDK on a product you do not own or have permission to instrument
  • Collect behavioral data from users who have not been informed about such collection via your own privacy policy
  • Use Captawave to collect or process special categories of sensitive personal data (health, financial, biometric, etc.) without a separate written agreement with us
  • Attempt to reverse-engineer, copy, or resell any part of the Captawave platform
  • Use Captawave to spam, harass, or harm your end users
  • Exceed the signal volume limits of your plan in an attempt to circumvent billing
  • Attempt to access another customer's data

5. Your responsibilities toward your end users

When you install the Captawave SDK in your product, you become responsible for ensuring your end users are properly informed. Specifically, you must:

  • Disclose behavioral data collection in your own product's privacy policy
  • Obtain any consents required by applicable law in your jurisdiction
  • Honor end user deletion requests by submitting them to us via the data deletion API or dashboard

Captawave processes your end users' behavioral data as a data processor on your behalf. You are the data controller for that data.

6. Billing and payment

Plans and pricing

Captawave offers Free, Starter ($49/mo), Growth ($149/mo), Pro ($299/mo), and Enterprise (custom) plans. Current pricing is always available at captawave.com. We may change pricing with 30 days' notice to existing customers.

Billing cycle

Paid plans are billed monthly in advance. All payments are processed by Stripe. Your subscription renews automatically at the end of each billing period unless cancelled.

Refunds

We offer a full refund within 14 days of your first payment on any paid plan if you are not satisfied. After 14 days, payments are non-refundable except where required by law. To request a refund, email hello@captawave.com.

Downgrade and cancellation

You can downgrade or cancel your account at any time from the Settings page. Cancellation is effective at the end of your current billing period. We do not make cancellation harder to find than upgrade.

7. AI-generated content

Captawave uses AI to generate review drafts, recommendations, churn alerts, and other outputs. You acknowledge that:

  • AI-generated outputs are suggestions, not guarantees. They may be inaccurate.
  • You are responsible for reviewing AI-generated review drafts before approving publication.
  • You are responsible for any content you publish through Captawave's integrations.
  • Captawave is not liable for decisions you make based on AI-generated insights.

8. Intellectual property

Captawave owns all rights to the platform, codebase, design, and underlying technology. These Terms do not grant you any ownership rights to Captawave.

You own all data you bring into Captawave — your customers' behavioral signals, your company data, and your settings. Captawave has a limited license to use that data solely to operate and improve the platform as described in the Privacy Policy.

You retain ownership of any review content you create or approve through Captawave.

9. Uptime and availability

We aim for 99.9% uptime. We do not guarantee uninterrupted access to the platform. Scheduled maintenance will be announced in advance where possible. The Captawave SDK is designed to fail silently — if our servers are unreachable, the SDK will queue signals locally and retry when the connection is restored.

10. Limitation of liability

To the maximum extent permitted by applicable law, Captawave is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising from your use of the platform.

Our total liability to you for any claim arising from these Terms or your use of Captawave is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Captawave harmless from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.

12. Termination

Either party may terminate this agreement at any time. You can cancel via the Settings page. We may suspend or terminate your account if you violate these Terms, with notice where practical. Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

13. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Georgia.

14. Changes to these terms

We will notify you by email at least 14 days before any material changes to these Terms take effect. Continued use of Captawave after the effective date constitutes acceptance of the updated Terms.
